Harvard Law Professor: Christians Should be Treated Like Nazis

A Harvard law professor has written a blog post in which he says conservatives have lost the culture wars and should be treated like the Nazis or others who have ended up on the wrong side of history.
The Washington Times reports that in his blog post, Harvard law professor Mark Tushnet asserted that conservatives and Christians are on the losing side when it comes to the culture wars. The question now remains, according to Tushnet, of “how to deal with the losers.”
“My own judgment is that taking a hard line (‘You lost, live with it’) is better than trying to accommodate the losers,” he wrote.
“Trying to be nice to the losers didn’t work well after the Civil War, nor after Brown,” Tushnet continued, referencing the Supreme Court case on segregation, Brown v. Board of Education. “And taking a hard line seemed to work reasonably well in Germany and Japan after 1945.”
Tushnet added that liberals shouldn’t hesitate to use the judiciary system to advance their agenda. Now that conservative Justice Antonin Scalia has passed away, Tushnet said liberal ideology won’t face significant backlash in the Court.
Heritage Foundation senior research fellow Ryan T. Anderson disagrees with Tushnet, stating, “Liberals aggressively sought in the courts an unlimited abortion license, a redefinition of marriage, and now for transgender bathroom policies throughout the nation. Liberals haven’t been bashful to use the courts to reshape social policy when they couldn’t win at the polls.”
Anderson also condemned Tushnet’s comparison of Christians to Nazis:
“Ah, yes, if the ‘losers’ of the American ‘culture wars’ are the functional equivalent of racists and Nazis, then Tushnet’s argument works wonderfully,” he said. “But if Orthodox Jews, Roman Catholics, Evangelical Christians, Latter-Day Saints, faithful Muslims, and other Americans who believe that marriage is the union of a man and woman are decent members of society, maybe Tushnet should reconsider his hostility.”
