HIGH COURT TO WEIGH PARTIAL BIRTH ABORTION: The nation's highest court just announced it. The Supreme Court WILL hear the first of three appeals on the issue of partial-birth abortion.
And be ready when they do, because I am predicting and earth shaking shiver to slide down the spines of the pro-death camps that support "on demand abortion." I do think it will be closely contended - but I see a 5-4 vote coming on the question of the federal legislation.
In 2003, Congress passed the measure for something like the 8th year in a row. Stupid liberals in the Senate kept it from getting to President Bush's desk in the first two years of his first term. But after the "Jeffords jump," the voter's did the "Daschle dump" and Frist and company were finally able to move the legislation back to the executive desk. (The measure had been vetoed by Clinton not once but thrice.)
For the uninitiated it might be relevant to describe the procedure that even long time Democrat Patrick Moynihan termed "murderous." This procedure was long ago ruled out by the AMA as EVER being necessary to salvage the life of the mother.
It begins by inducing labor...
Delivering the child to within 2-3 inches of complete birth...
Thrusting a pair of scissors into the base of the cranium of the child and pushing them through the brain of the child...
Crushing the childs brain into complete mush and removing the scissors...
Suctioning the brain matter out of the now dead child's cranial cavity...
And finally delivering the now dead child the final two inches...
NEVER medically necessary, VIOLENT and painful to the child it is being performed against, and something better than 80% of Americans find morally repulsive. Thus the longstanding reason as to why the measure always passed the legislature in such huge numbers with Democrats and Republicans often voting in favor of a ban. As for the Supreme Court, it is fairly obvious where Breyer, Ginsburg, Souter, and Stevens will vote. (Though believe it or not Souter might be a wild card in terms of a reliable liberal move on this...) On the right Scalia and Thomas have fixed positions on the matter. It is my opinion that Roberts and Alito will also prove "originalist" on the matter. With a 4-4 standing, it all comes down to Kennedy. And while he has voted to support Roe in the past, he also voted in 2000 in the Stenberg case to allow the state of Nebraska to determine as to whether it would impose a state-wide ban on partial birth abortions. That case is the precedent that most closely parallels the federal ban case.
We are a long way from returning the right to the states to determine if they wish to offer abortions (overturning Roe v. Wade), we may soon see an end to the truly most barbaric act ever allowed against a human being - that of brutally killing our youngest and most vulnerable while they are being birthed.
