Court Rules against Woman Who Filed Complaint against Planet Fitness' Transgender Policy

A woman who took a complaint against Planet Fitness’ transgender bathroom policy to court has lost her case.

The Daily Wire reports that a Michigan court ruled against Yvette M. Cormier in her complaint that sharing a bathroom facility with a transgender woman made her feel uncomfortable.

Cormier first took her complaint to Planet Fitness management, but they informed her that their restrooms were available for use based on gender identity and that the transgender woman, a biological male, was allowed in the women's restroom.

After Cormier began to warn other women about the transgender woman, Planet Fitness reportedly cancelled her membership.

Cormier then took her case to court, citing “invasion of privacy, sexual harassment under the Elliott-Larsen Civil Rights Act (CRA), retaliation, gender-based discrimination, breach of contract, intentional infliction of emotional distress, and violation of the Michigan Consumer Protection Act.”

Cormier ended up losing the case.

“[T]he CRA does not define sexual harassment as being subjected to an opportunity for a person to engage in verbal or physical conduct or communication of a sexual nature. Rather the CRA requires that the sexual conduct or communication substantially interfered with the plaintiff’s utilization of public accommodations,” said the court in their decision.

Cormier’s lawyer, David Kallman, said they are planning to appeal the case to the Michigan Supreme Court.
