A Nashville swingers club is now claiming it is a church so it can earn city approval to open next to a Christian school.

The club is called The Social Club and its new building is near the back of Goodpasture Christian School, a private school for students in preschool to high school.

School officials found out about the club after anonymous letters were sent to the school, and parents and others planned to protest a zoning change to keep the new club from opening.

But The Social Club then became a church, calling itself United Fellowship Center.

"The ball is in Metro's court ... We've now gotten a permit to meet as a church, and a church is something that cannot be defined under the U.S. Constitution," said Larry Roberts, attorney for the “church.”

Roberts said they will meet in the building but there will be no sex there.

"If people have something else in mind, they will go somewhere else,” he said.

But Goodpasture President Ricky Perry said he isn’t convinced.

"I find it hard to believe that they've invested that kind of money and they're just going to change the activity," he said. “I really hope that it's true."
