I agree on the concept of foreign combatants and that the Constitution was never designed to protect them; however, the United States has signed International Agreements (Geneva Accords), the UN Human Rights Charter as well as prisoners of war being governed by both the Code of Conduct (which military, such as myself, are required to follow) and the Uniform Code of Military Justice.

The Taliban and Al-Qaeda prisoners are classified as prisoners of war (for we are at war) but they must be treated as such and under the auspices of International law. We never tortured Japanese or German prisoners of war and no Chrisitan (even our President) should condone torture as excusable to obtain information.

No matter what these people did or who they are affiliated with, they are still human beings and must be treated as such. If not, then we are hypocrites for we scream vengeance when we see American POWs executed on the Internet. When we do the same, what does that say about us?
